Terms of Service
These Terms of Service (TOS) govern your use of this site and your relationship with us (the “Contract”), the Service and the Application Online Booking, as well as to all information and/or services provided to you on or through the Website, the Service and the Application.
These terms of use are subject to change by our company at any time in its discretion.

Use of Website / Online Booking
The Website / Online Booking is provided to you for your personal use subject to this Terms of Service. By engaging in our service you agree to be bound by this Terms of Service.

Prohibited Items & Items with limited liability

Constant Courier is not a common carrier and carriage of documents or parcels is subjected to conditions set out herein. Constant Courier reserves the right to refuse carriage or transportation of any documents or parcels for any person’s firm or company and of any class of documents or parcels at its absolute discretion.

The customer warrants that he or she has complied with all laws and regulations relating to the nature, condition, packing, handling, storage and carriage of the Delivery Items. The User shall not dispatch and Delivery Providers reserve the right to refuse any Delivery Item that is prohibited by law, dangerous or hazardous materials, perishable substances and radioactive material, without limitation:

Explosives, firearms or other offensive weapons, flammable or hazardous materials, poisonous or infectious substances, blood or blood products (whether infectious or not);

Human or animal remains;

Live animals;

Original copies of any record, drawing, document or electronic recording of which duplicates, or copies have not been made and kept by you;

Precious metals and stones; and
-
Illegal narcotics or drugs.

Any items classified under the General Prohibitions list as defined under the Singapore Postal Services Regulations 2008, the Health Sciences Authority of Singapore and the latest UPU Regulations. All senders are to note the prohibitions and refer to the relevant authorities when in doubt. Where there is a conflict or contradiction between the Singapore Postal Services Regulations 2008 and UPU Regulations, the Singapore Postal Services Regulations 2008 will take precedence.

Collection & Delivery

Constant Courier will only carry documents or parcels which are the customer’s property and warrants that it is authorised to accept and is accepting these conditions on behalf of itself and also as agent and on behalf of all other for and on behalf of the owner of the Delivered Items. The customer hereby undertakes to indemnify Constant Courier against any and all losses, damages and expenses arising from any breach of this warranty.

Constant Courier has the discretion and reserves the right to carry customer’s documents or parcels via any route and procedure and by successive carriers and according to its hading storage and transportation methods as Constant Courier thinks fit.

Charges and Payment

Constant Courier undertakes, subject to payment in accordance with RATE(S) notified to the customer from time to time to carry customer’s documents or parcels between destinations agreed between Constant Courier and its customer.

All rates quoted by Constant Courier for carriage or despatch are exclusive of additional cost such as tax, duties, levies, deposits or outlays incurred on as a result of carriage of customer’s documents or parcels. Should the customer indicate by endorsement in the space provided or on the Consignment Note that the recipients shall be liable for any additional costs as described herein during the carriage of the customer’s documents or parcels, the customer undertakes to indemnify Constant Courier for such additional costs incurred in the event of default in payment by the recipient.

Customer will make payment to Constant Courier within 30 days of receipt of the invoices raised by Constant Courier, or via Cash in Singapore Dollars.

Delay / Damage / Loss

Constant Courier will not be liable for any penalties imposed or loss or damages incurred in the consequence of the customers’ documents or parcels being impounded by Customs or other competent authority. The customer hereby undertakes to indemnify Constant Courier against such penalty, loss or damage.

Constant Courier shall not be liable for any or all loss, damage and expenses arising as a result of the customer’s failure to comply with its obligations set out in the conditions herein or as a result of the customer’s own negligence.

Constant Courier shall not be liable for any or all loss, damage and expenses arising as a result of the customer’s own negligence/failure to seal envelope, bag, box, or any other protective container of the documents or parcels, or customer’s failure to instruct any third party to seal envelope, bag, box, or any other protective container of their documents or parcels.

If the recipient accepts the parcels without noting any damage on the delivery record, we will assume the parcels was delivered in good conditions. In order for us to consider a claim for damage, the contents, original packages must be avalaible for us for inspection.

All lost and damaged parcels have to be reported within six (6) hours. Lost and damaged parcels reported after the specified time frame will not be eligible for the compensation claim.

Limitation of Liability

Constant Courier’s liability to customers is limited to the maximum sum of S$300 of any damages in whatever manner, whether through negligence, misconduct, fraud or any criminal activity on the part of its staff, employees, agents or anyone acting on its behalf.

Constant Courier will not be responsible for any claims whatsoever for losses, claims including third party claims, general or special damages, penalties, costs, expenses of any kind whatsoever which may arise from or as a result of any act, omission or negligence, misconduct, fraud or criminal activity or any other reasons whatsoever.

Late deliveries

Constant Courier shall not in any circumstances be liable for any late delivery or missed delivery or failure to deliver caused by:

any deficient or ambiguous labelling of a consignment note
-
a strike, lock out, labour dispute, weather conditions, traffic congestion, mechanical breakdown or obstruction of any public or private road or highway or any other cause beyond their control

Indemnity

By accepting the Terms of Service and using the Service and the Application or Consignment Note, the customer shall indemnify the Company and keep the Company indemnified against all demands, claims, action, proceedings, costs, charges or expenses including but not limited to penalties, storage charges, retrieval and administrative costs, duties and taxes incurred, suffered or sustained by us in connection with the Service we have provided.

Miscellaneous

Constant Courier shall under these conditions also include its appointed agents, sub-agents or part-time employees or contractors.

We reserve the rights to revise the Terms of Service at any time without prior notice.

All agreements or arrangements made between Constant Courier and its customer shall be governed by and construed in accordance with Singapore Law and brought within the jurisdiction of Singapore courts.
